Acceptance of Terms

By accessing or using ZempFlow, you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you agree to these terms for that organization.

User Accounts

You must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

Subscriptions & Billing

Paid features require a subscription billed monthly or annually via trusted payment gateways. All fees are non-refundable unless required by law. We may change pricing with 30 days' notice.

Data Processing & AI Features

The Service processes communication data from channels you connect. AI features utilize third-party API providers (such as OpenAI or Anthropic) to process data and generate responses. We do not use your customer data to train public models without explicit consent. By using the service, you also agree to our Data Processing Addendum (DPA).

Third-Party Channels & Compliance

ZempFlow integrates with third-party platforms (including Meta/WhatsApp, Instagram, Telegram). Your use of these channels through ZempFlow must comply with their respective terms of service. ZempFlow is not liable for any account suspensions, bans, or penalties imposed on you by third-party platforms.

Acceptable Use & Anti-Spam

You agree not to use the Service to send unsolicited communications (spam), violate local communication laws (e.g., TCPA, CAN-SPAM, GDPR), upload malicious code, or exceed reasonable usage limits.

AI Output Disclaimer

AI-generated content is provided as a tool. ZempFlow does not guarantee the accuracy, correctness, or compliance of AI-generated responses. You assume full responsibility for any automated actions or messages sent to your customers via our AI features.

Intellectual Property

The Service is the property of ZempFlow. You retain ownership of your input content. AI-generated content becomes yours once accepted or transmitted through the platform.

Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, ZempFlow's total liability is limited to the amounts paid by you in the preceding 12 months.

Termination & Data Retention

You may terminate your account at any time. Upon termination, data is retained for 30 days to allow for export, after which it is permanently deleted from our active servers.

Law Enforcement and Legal Compliance

We cooperate with government and law enforcement officials to enforce and comply with the law. We reserve the right to disclose any information or data regarding our users or their customers to government or law enforcement officials if we, in our sole discretion, believe it is necessary or appropriate to respond to claims and legal process (including subpoenas, warrants, or court orders). ZempFlow may disclose this data without obtaining your prior permission and without providing notice to you, where permitted or required by law, to protect the property and rights of ZempFlow, to protect public safety, or to prevent or stop activity we consider to be illegal, unethical, or legally actionable.

Changes to Terms

We may update these Terms with at least 14 days' notice via email or dashboard notification. Continued use constitutes acceptance of the new terms.
